The measure taken by France, via its relevant market surveillance authority, Agence Nationale des Fréquences, notified on 5 October 2023, in accordance with Article 40(4) of Directive 2014/53/EU, via the information and communication system referred to in Article 34(1) of Regulation (EU) 2019/1020 (ICSMS)(25), to withdraw iPhone 12 A2403, manufactured by Apple Inc., from the market, is justified.

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Directive 2014/53/EU of the European Parliament and of the Council of 16 April 2014 on the harmonisation of the laws of the Member States relating to the making available on the market of radio equipment and repealing Directive 1999/5/EC(1), and in particular Article 41(1) thereof,
